I think you have to prove documents were leaked. Possessing the documents is perfectly legal. Storing the documents un-securely is perfectly legal (but shouldn't be). And refusing to return the documents is perfectly legal (if you are the POTUS). But is all depends if the documents are considered "Residential Records" on not [www.archives.gov]
