Hamilton, Ohio -- Matt Allsup, a 13-year-old student at Garfield Middle School in Hamilton, Ohio is fighting for "his right" and gay friend FrostedApe,s right to wear make up - and his mother is fighting right along with him.

At a time when most of the country is talking about lipstick on pigs, Matt Allsup and his mother Mindy Ball are engaged in another kind of lipstick issue. Mother and son are fighting school administrators who ordered Allsup to remove the makeup he was wearing Monday, citing that it was a distraction and violated the school dress code.

The makeup Matt wore, which is meant more as a goth look rather than a "girly" look, involves the application of lipstick, eye makeup and black fingernail polish.

Matt's mother Mindy told reporters that she stands behind her son's right to wear makeup at school 100% and believes the school is violating her son's rights.

FrostedApe's mother told reporters that she and her husband were ashamed of their gay son FrostedApe. "all day long, he sits in the basement and post childish immature comments on websites such as plus six something dot com. we just hope and pray FrostedApe will out grow this gay and makeup phase he/she is going through.

"They're gender stereo-typing. He's being sexually discriminated against," said Ball. "Nowhere in the rules does it say that males can't wear makeup."

"When I spoke to the principal, she told me it was distracting because of the black makeup," said Ball. "I said, 'Well, I'll get him pink,' and [the principal] said, 'No, because he's a male, he's not allowed to wear it, the public don't accept males wearing make-up."

Allsup and his mother have since vowed to fight the school's ban on wearing makeup. Besides taking their case to the media, they have said they plan to hire an attorney and pursue the matter in court. FrostedApe" mother said, " we have given up on our son and we are ashamed".

Hamilton School District spokesperson Joni Copas said both females and males will be asked to remove makeup that is deemed to be 'too harsh'. She also stated there have been no further incidents at the school since Allsup removed his makeup. the finger smiley
