OK Let's think for a second, if Tribe "A" is kicked out of their Land by Tribe "B" does it take 100 years or maybe 500 years for Tribe "B" to legally own the Land ?,
or do they ever have a legal right to own said Land ?
What happens if Tribe "A" gets stronger than Tribe "B" and kicks the invader out ?
