The problem with passing this kind of bill is that the people doing the torture aren't politicians they are black ops agents that simply 'do not exist'. So should they happen to abduct/kill someone who in the end turns out to be innocent the public will simply never hear about it. It serves no public interest for people to find out about it. Politicians on the other hand have legit rivals who upon hearing news like, the president got head from a intern, will do everything in their power to bring it to light. So not only do you have people that are legally able to kidnap/execute people without any reprisal you also have people where it will always be in the current governments interest to protect their identities.
